Indiana prosecutes many drug cases every year, and how you are "caught" with those drugs will determine if it is not a crime at all, a crime of illegally possessing, a crime of dealing (more on this in a different section). Possession drugs illegally can be either a misdemeanor or felony charged depending on certain factors that include: weight of the drugs, prior convictions, and if a firearm is involved.
Dealing drugs is a very serious charge in Indiana and although there are misdemeanor level offenses for dealing, it is more likely you will be facing felony charges for dealing drugs. You can also be charged for something call "possession with intent to deal". This is a dealing offense even though no drug deal was happening, and that is because of the surrounding circumstances success as: a lot of drugs, how the drugs are packaged, weighing scales, and large amounts of cash.
In Indiana you can be charged with a criminal offense just for having paraphernalia that is used to ingest illegal drugs and substances. The State will look at the surrounding evidence to determine if there is residue on the paraphernalia or if there are drugs near the item that is considered paraphernalia.
Certain crimes in Indiana can be enhanced depending on things like: the weight of the drugs or controlled substances found; if you have a prior conviction for a drug offense; if there is a firearm found during the investigation.
